Land Acquisition Relocations

Relocation Program:  The objective of the District's relocation program is to comply with the guidelines of the Uniform Relocation Assistance and Real Property Acquisition for Federally-Assisted Program Act of 1970 (Public Law 91-646), subsequent amendments, and the Code of Federal Regulations (CFR), Title 49, Part 24 which provide for legal procedures that must be followed for Federal and/or Federally assisted projects. "The purpose of the title (Act) is to establish a uniform policy for fair and equitable treatment of persons displaced from their homes, businesses, or farms as a result of federally-assisted programs in order that such persons shall not suffer disproportionate injures as a result of programs designed for the benefit of the public as a whole." The District's goal is to ensure that displaced persons receive the appropriate allocation allowed under the laws.

In order to meet these goals, the relocation program is managed and supervised by the District's Senior Relocation Specialist, who in turn advises and reports all relocation requirements to the Deputy Department Director, Land Acquisition and Land Management Departments, and then the Director, Land Acquisition and Land Management Departments, who has the ultimate responsibility and authority for the District's relocation program. The relocation staff coordinates tracts and processes all of the tasks associated with relocation activities in keeping within the scope of the project acquisitions, ultimately meeting the needs of the displaced families or business operations.

Certification Program:  The purpose of the District's certification, crediting, and reimbursement program is a coordinated process between the United States Army Corps of Engineers (USACOE) and the District for certification of lands acquired for jointly funded projects. In essence the program ultimately allows District land purchases to be applied as the District's cost share portion on District-Corps of Engineer projects. As an example, once the District purchases a land interest for a joint project, a certification package is prepared and submitted to the USACOE for their review. Once the USACOE approves the need for and the purchase of the land, they apply the acquisition as a credit towards the District's share of the project. The District retains its interest in the land and the USACOE has the authority to use the lands for the project. These lands will not be disposed (surplus) of without the approval of the USACOE.
